Supreme Court To Hear Case Involving Fired Trucker

Truck driver Douglas J. Horn is challenging his termination all the way to the Supreme Court. The high court agreed on April 29th to hear his case against Medical Marijuana, Inc.

In 2012, after an injury, Horn used "Dixie X" for chronic pain. Marketed as a THC-free CBD product, Dixie X allegedly triggered a positive drug test leading to Horn's dismissal.

In 2015, Horn sued the companies behind Dixie X, accusing them of violating the Controlled Substances Act and fraud. He also based his case on the Racketeer Influenced and Corrupt Organizations Act (RICO), a powerful law typically used against organized crime but allows for tripled damages.

A lower court allowed the RICO claim to proceed, which Medical Marijuana, Inc. is appealing. They argue using RICO in such cases could lead to a surge of similar lawsuits. The Supreme Court's decision will determine if Horn's case can proceed under RICO or if the law has limitations in such situations.
